The European Union Intellectual Property Office’s (EUIPO) Opposition Division recently rejected Chanel’s opposition to a European trademark application using the number \u201c5\u201d to protect cosmetic products. But how? And why? Here’s how.<\/h4>\n

The sometimes complicated relationship between intellectual property and the world of perfume has a bright future ahead of it*. Chanel<\/strong>, which recently obtained the registration of two international designs protecting the new limited-edition bottle of its N\u00b0 5 perfume, opposed the application for European Union figurative mark 5 n\u00b018 872 562<\/strong> filed by a Slovenian company to cover cosmetic products (notably perfumed creams and lotions). In a decision dated June 17, 2024,<\/strong> the EUIPO dismissed the opposition, considering that the earlier trademarks invoked by Chanel had normal distinctive character, and ruled out any likelihood of confusion with the contested trademark application.<\/p>\n

While we find the EUIPO’s conclusion questionable, the opposition filed by Chanel raises as many questions as it raises lessons, which will be addressed in this article.<\/p>\n
