HUAWEI ACCUSED OF PLAGIARISM : CHANEL LOSES ITS APPEAL

After Chanel filed a first complaint in 2019 against Huawei that was rejected, the French fashion house’s appeal also suffered the same fate yesterday, Wednesday. And for good reason, the authorities considered that the similarities between the logos of the two companies – too similar for Chanel’s taste – were not sufficient. Chanel is therefore losing the battle against the Chinese technology firm.

 

It should be noted that the conflict between the two brands dates back to 2017. Huawei had then filed the logo of a hardware trademark with the Office of the European Union, in order to protect it. The logo consists of two vertical semi-circles, representing the Huawei H. Then a thin circle is visible around the two semi-circles.

 

All fashion and luxury enthusiasts know the emblematic logotype of Chanel, these two intertwined Cs representing the initials Chanel, its trademark. The reason why Chanel very quickly wanted to prohibit the registration of Huawei’s logotype. According to Chanel, Huawei has completely plagiarised and imitated its logo. A complaint was therefore filed for the first time by the fashion house with the Intellectual Property Office.

 

But in 2019, the Trademark Office dismissed Chanel’s complaint, with the court saying “there was no similarity or potential for confusion in the public mind. “. Chanel subsequently appealed this court decision, to the Luxembourg High Court, which also rejected the appeal on Wednesday 21 April.

 

“The figurative marks at issue are not similar. In particular, Chanel’s marks have more rounded curves, thicker lines and a horizontal orientation, whereas the orientation of the Huawei mark is vertical. Consequently, the Court of First Instance concludes that the marks are different,” the EU General Court ruled, stressing that the “logos must be compared as applied for and registered, without changing the orientation of the elements”.

 

Chanel can still appeal to the European Court of Justice to challenge this decision. For the time being, Chanel has not yet commented or made a decision.
